The facts
What the bill actually says, no spin.
- Insurance companies must pay any storage fees before the dealer can act.
- If a claim is denied, the insurer must notify the dealer to release the vehicle to the owner or lienholder.
- The dealer must send a certified notice giving the owner 30 days to pick up the car and pay any charges.
- If the owner does not pay or pick up the car, the vehicle is declared abandoned and the title is assigned to the dealer.
- The dealer can then request a new clean title for the vehicle, paying a fee set by the department.
